Answers to common questions about private parking, Parking Breach Notices, payments, appeals and debt collection

Legal Basis, Vehicle Information & Legitimacy

Are private Parking Breach Notices enforceable?

Parking terms and conditions on private property may be enforced under the applicable laws of New Zealand or, in Australia, the relevant state or territory.

In both countries, private parking arrangements can create contractual rights and obligations where parking conditions are appropriately communicated and accepted. The applicable parking conditions, including any breach fee, are displayed at the location.

Where those conditions are breached, the property owner, occupier or authorised enforcement operator may take enforcement action in accordance with the applicable terms, consumer protections and other laws applying in that jurisdiction.
